RULES OF OPERATION OF AWARDS PURSUANT TO LEGISLATIVE DECREE NO. 430 OF 26 OCTOBER 2001 “VOLARE”

1.   DEFINITIONS

Volare Code: indicates the personal numeric code provided to the member.

Program: indicates the award operations aimed at retaining the Promoter's customers.

Award:indicatesthe airline ticket, discounts on the purchase of airline tickets or other awards obtainable using the Points accumulated in accordance with the terms and conditions of these Regulations, including dedicated on-board services both on-air and on-ground (including, without limitation, services lounges and upgrade of class).                          

Promoter or ITA Airways: indicates ITALIA TRASPORTO AEREO S.p.A., as identified in the following article 2.

Points:indicates the unit of measurement of the Program.

Regulations: indicates the set of rules and regulations contained in this document (as amended from time to time), on the site www.ita-airways.com and/or in any communications relating to the Program that govern the functioning of the same Program.

Member: indicates the natural person participating in the Program by virtue of his or her adherence and acceptance of the Regulations.

2.   PROMOTER

ITALIA TRASPORTO AEREO S.P.A. (in abbreviated form, ITA Airways S.p.A.), with registered office in Via XX Settembre 97 - 00187, Rome, VAT number, tax code and  registration number to the Business Register 15907661001.

3.   DURATION

     From 15 October 2021 to 15 October 2024, unless extended.

    In any case, the total duration of the operation, including any extensions, will be less than five years.                           

4.   RECIPIENTS OF THE AWARD OPERATIONS

The recipients of the Program are all natural persons who will purchase the goods and services promoted by the Program on the basis of the conditions of these Regulations.                           

5.   PROCEDURE AND PROGRAM PHASES

Registration for the Program is always free.

To join the Program it is necessary to register through the website www.ita-airways.com or the "ITA Airways" application, downloadable from the following app stores: Apple Store and Play Store, or through other channels communicated from time to time by ITA.

All natural persons who, starting from 15 October 2021, have reached the age of 16 and whose transport by air is paid for with ITA, can participate in the Program.It is understood that, in the event that the national legislation applicable to a minor Member provides for the need to obtain authorizations or consents from the holder of parental responsibility, enrollment in the Program by the minor of age is subject to the previous valid obtaining of such authorizations or consents, of which the holder of parental responsibility must be able to provide documentary attestation to ITA at any time, and is subject to the responsibility of the holder of parental responsibility.                           

Upon enrollment in the Program, the Member will be asked to generate credentials (email, password) and to provide the data (name, surname, date of birth, telephone number, address and gender) necessary to enter his or her personal area.The personal data that will be provided by Members upon enrollment in the Program must be correct and truthful in every aspect. At the first login attempt, the Member will be asked to confirm the email address provided by the Member when registering for the Program and, if the verification is successful, each person will be associated with a single profile for the purposes of participating in the Program and, therefore, each Member may have only one Points portfolio.

The Program is divided into two phases (Phase I from 15 October 2021 until and no later than 28 February 2022; Phase II from 1 February 2022 until the end date of the Program), as described in more detail below.

Each Member can withdraw from the Program at any time and without incurring any cost, using the appropriate section of the site www.ita-airways.com or via the "ITA Airways" app. The deletion of the profile will take effect immediately and also, therefore, the member's personal data will be deleted and the Points still present in their Points portfolio will be deleted.

ITA Airways reserves the right to carry out appropriate checks on compliance with these Regulations and to deny participation and/or exclude Members from the Program and/or cancel any Points and/or Awards requested, to subjects who do not meet the requirements set out in the Regulations or in the case of participations made , according to the unquestionable judgment of ITA Airways or of third parties appointed by the same, not respecting the conditions provided for by the Regulation or with means, methods and/or tools that, at its sole discretion, are considered suspicious, fraudulent or in violation of the normal course of the initiative.

PHASE I

Members who join the Program by 15 November 2021 will be entitled to a welcome bonusof 10,000 Points ("Welcome Bonus") to be used within the Program once the usage features are active (Phase II). In particular, the welcome bonuswill be credited to the Member's Points balance by 28 February 2022 provided that the Member purchased a return flight or two one-way flights to be made by 31 December 2021. These Points can be used starting from 1 March 2022 above (see Phase II, paragraph b)); these Points will also be counted for the purpose of calculating the thresholds for access to the Exclusive Clubs referred to in Article 7 below.

PHASE II

No later than 28 February 28 2022, the Member will receive the Volare Code corresponding to his/her “Volare” account. Using the Volare Code in their reserved area, the Member can:

  • access Points wallet;
  • receive, as soon as technically possible the Points accrued as a result of each flight made by the Member and each purchase that gives the right to accumulate Points (see Phase II, paragraph a));
  • receive the credit of the Points accrued for ITA Airways flights carried out from 15 October 2021 to 28 February 2021 (previously only tracked in the Member's personal area).
  • use the Points recovery function in the personal area of each Member to receive the credit of the Points connected to purchases prior to obtaining the Volare Code, according to the criteria communicated from time to time communicated by ITA Airways and without prejudice to the necessary indication, by part of the Member, of the codes that make it possible to identify the goods/services purchased (e.g. ticket code).

a)     Accumulation of Points

Each Member will have access to a personal account to which the corresponding Points will be accumulated and credited. Points will be credited automatically in each of the circumstances listed below, it being understood that it remains the responsibility of the Member to provide their Volare Code at the time of purchase of the goods/services promoted by ITA Airways:

  • flights with ITA Airways actually purchased by, or on behalf of, the Member, and carried out by the same person. It is understood that flights purchased but not taken (even due to cancellation and without prejudice to the application of the ITA Airways policy regarding the possible recognition of related refunds) do not give the right to accumulate Points;
  • purchase and use of goods and/or services provided by ITA Airways (boutique  on board), as soon as technically available;
  • purchase of ancillary services available for a fee on ITA Airways flights; the Points that will be recognized for the purchase of these ancillary services will not be counted for the purpose of calculating the thresholds for access to the exclusive Clubs referred to in the following article 7 and the multipliers provided for in relation to membership of these Clubs will not apply Exclusive;   
  • further methods of earning Points communicated from time to time by ITA Airways.

The amount of points accumulated is calculated on the basis of the customer's expense (the so-called revenue-based model), net of the amounts related to taxes and other charges (VAT included), starting from the model 1 euro = 10 points (with possible increases related to the membership of the Member in one of the Exclusive Clubs referred to in article 7 below and according to the purchased ticket type, as per Annex A).

The accrual of Points by virtue of the purchase of airline tickets may also take place based on the type of purchase made (class, destination, etc.), with the possibility of receiving bonus points in a manner that will be communicated by ITA Airways from time to time.

Special modes of earning Points, subject to updates

Members who in the period between 1 March and 31 March 2022 (subject to possible extensions) have purchased a flight, to be carried out in the period between 1 March and 31 August 2022, will be able to benefit from the "Double Points ”, which will allow Members to earn double the Points that would have been ordinarily awarded. The additional points that will be recognized as part of this initiative will also be counted for the purpose of calculating the thresholds for access to the Exclusive Clubs referred to in Article 7 below. These Points will be credited by 30 September 2022, provided that the Member has flown the flights purchased by the aforementioned date of 31 August 2022.

b)     Use of Points

Starting from 1 March 2022, Members will have the opportunity to use the Points accrued according to the criteria indicated in paragraph a) to request the following Awards:

  • purchase of ITA Airways tickets (the indicative values are shown in Annex A);
  • purchase of ITA Airways extra services (at the time of booking and at check-in, as soon as they are technically available).
  • purchase of ITA Airways discount coupons, as soon as they are technically available.

The Points will be used through a dedicated section of the site www.ita-airways.com, through the ITA Airways application and other methods communicated from time to time to the Member, as well as according to the methods defined and communicated from time to time by ITA Airways. In particular, before concluding each purchase, at any time and for any class of all flights available on the site www.ita-airways.com, the Member in question, making sure that he/she has logged in to his/her personal profile, will have to enter his/her Volare Code and the transaction will take place automatically by deducting an amount equivalent to the price of the good/service purchased from the points balance (so-called "Cash&Points” system). It is understood that taxes and other applicable charges (VAT included) cannot be paid through the use of Points.

Points will be converted into different currencies according to the IATA exchange rate, which is subject to monthly updates. In the event that the Member's Points balance is not sufficient to cover the full price of the good/service he/she intends to purchase, the price of the good/service will in any case be reduced by the amount of the Points available. Upon completion of the transaction involving the use of the Points accumulated for the purpose of purchasing goods and/or services offered by ITA Airways, the Member will have visibility of the Points used in the summary of the payment, on the statement of account and in their Points portfolio.

For the reimbursement of goods/services purchased with the use of Points, the reimbursement policies of ITA Airways will apply and, where the relevant conditions are met, the reimbursement will be recognized using the same means of payment as the original purchase (Points, money or a set of Points and money, it being understood that airport taxes will always be refunded in cash). If the refund is made, in whole or in part, by crediting the Points, the Member will see, as soon as technically possible, the update of the Points available in their Points portfolio.

It is understood that the Points and/or Awards that will be awarded to Members will not give any right to request their conversion into cash. The Member will not be able to accumulate additional Points as a result of the award and use of a Award that was obtained, in its entirety or in part, by using the accumulated Points, unless otherwise specified and communicated to Members by ITA. It is also specified that the following types of tickets will not be entitled to accumulate Points: (i) tickets subject to special favorable conditions (e.g., tickets for employees, humanitarian flights, flights organized by national authorities), (ii) tickets booked in class G (group fares).

In relation to the goods purchased with the use of Points, the legal guarantee of compliance is governed by Articles 128 and successive mod. of Decree-Law 206 of September 6, 2005 (Consumer Code).

6.   PROGRAM PARTNERS

ITA Airways reserves the right to communicate to the Members, and to make the consequent changes to these Regulations pursuant to Article 11 below, the initiatives, further collaborations as well as the list of partners of the current Program, in the process of being defined, which will give Members the right to accumulate and use the Points obtained through the purchase of goods and services offered by partners, under the terms and conditions that will be promptly communicated to the Members.

7.   EXCLUSIVE CLUBS

The Program allows Members to access the four exclusive ITA Airways clubs (as summarized below), divided into four levels which differ by virtue of the services that can be accessed, based on the volume of Points that each Member will accumulate under the paragraph b) of Phase II and regardless of their subsequent use for the purpose of awarding prizes ("Exclusive Clubs” system).

Each Member's access to the Exclusive Clubs will take place at the time the Volare Code is generated during Phase II (see article 5). During the program, once the points threshold indicated for access to the Exclusive Club of a higher level, such access will be recognized as soon as possible (in compliance with the necessary technical deadlines, in any case not exceeding 90 days), as per the relative communication that will be sent to the Member. Membership of this Exclusive Club will remain valid until the end of the calendar year following the year in which access to this Exclusive Club took place. The access to our Exclusive Clubs will entitle you to the following benefits (some examples are given below

  • Club Smart:
    • access by registering with the Program and accumulating Points for each expense related to goods/services offered by ITA;
    • access by registering with the Program and gain access to a wide network of commercial partnerships for the accreditation and use of the Points, as communicated from time to time pursuant to the previous article 5;
    • purchase of additional services using Points.

 

  • Club Plus (access and maintenance threshold: 30,000 points): 
    • benefits of the level Smart;
    • extra baggage;
    • priority delivery of baggage;
    • priority boarding;
    • priority access for check-in and transfer desk;
    • priority access to the lost property service (lost and found);
    • dedicated customer service.

 

  • Club Premium (access and maintenance threshold: 60,000 points):
    • benefits of the level Plus;
    • access to lounge;
    • free seat selection;
    • dedicated customer service;
    • priority boarding;
    • dedicated on-board welcome (as soon as technically available).

 

  • Club Executive (access and maintenance threshold: 90,000 points):
    • benefits of the level Premium;
    • access to lounge;
    • free seat selection;
    • dedicated customer service;
    • priority boarding;
    • welcome kit.

 

8.   NATURE AND VALUE OF THE REWARDS TO BE GIVEN

The indicative value of the individual Awards can be determined based on the value of the air fares in force at the time of their issue or the value of ITA Aiways's services/products or commercial partners at the time of their issue and the estimated value of the prize money is approximately EUR 2 million.

9.   TERMS OF THE DELIVERY OF REWARDS TO BE GIVEN

The Program allows you to accumulate Points until the deadline of October 15, 2024. The Awards may be requested by the Member by 15 November 2024, and will be delivered to the entitled party at the same time, with the exception of any Awards that must be delivered to the Member's home (which must be communicated when requesting physical Awards). ITA Airways undertakes to deliver within 90 days of the request.

10.  PROCESSING OF COMPLAINTS

Any complaints may be brought to the attention of ITA Airways by sending anemailto the address reclami@ita-airways.com from Italy and Complaints@ita-airways.com for non-Italian Members.

ITA Airways customer service will provide an answer as soon as possible and, in any case, within 20 days of receiving the complaint.

11.  AMENDMENTS TO THE REGULATIONS

ITA Airways reserves the right to modify, even partially and at any time, the modalities of participation in the Program, it being understood that such modifications will not affect the rights acquired in the meantime by the Members and that they will be adequately communicated with the same modalities with which the Program has been brought to the attention of the Members, or with equivalent methods (for example, by communication via email).

14.    REFERENCE AND CONFLICT OF RULES

For all matters not expressly provided for and regulated in these Regulations, please refer to the applicable laws and regulations, with particular reference to the Legislative Decree 26 October 2001, No. 430 (published in the Official Gazette 13 December 2001, No. 289), as subsequently amended and supplemented.

In the event of a conflict between the provisions of this Regulation and the mandatory provisions of the aforementioned legislation, the latter must be understood as prevailing over the former.

 

15.  APPLICABLE LAW AND JURISDICTION

The Promoter reserves the right to bring legal action against any Member who, by failing to comply with these Regulations, has engaged in fraud or attempted fraud or who in any case threatens the smooth running of the Program.

These Regulations are subject to Italian law.

For any dispute relating to this Program (and related Regulations) the court of the Member's place of residence will preside.
