These General Terms of Use govern access to and use of the ITA site by Users. Access to and use of the Site, as well as the purchase of airline tickets through the Site, require that the User has read, understood, and accepted these General Terms of Use.

In the context of these general terms of use, the terms and expressions listed below shall have the meanings given to them below:

Personal Account means the credentials known only to the Registered User, which allow them to access their personal information and manage, modify, and track Bookings they have made through the Site.

Customer or You means the natural person who, as a traveler or as a person who made the Booking and uses the Services (as well as Additional Services, if any) made available through the Site by the Company.

Company or Our means the company Italia Trasporto Aereo S.p.A., with its registered office at Via Venti Settembre, 97, Rome – 00187, tax code, VAT number, and registration number in the Business Registry of Rome 159070661001 (hereinafter, “ITA”), which through the Site manages the online booking of airline tickets, and provides Users with the requested Services.

General Conditions of Carriage means the conditions that apply to the transport of travelers performed by the Company, which must be accepted by you before proceeding with the Booking and using the Services.

General Terms of Use means these general terms and conditions, made available in the footer of the Site.

Applicable Law means any law (including, by way of non-limiting example: legislative decrees, decree-laws, regional or provincial laws, laws (civil, criminal, administrative, and tax and/or fiscal), royal decrees, Presidential decrees, Prime Ministerial decrees, ministerial decrees, etc.), directive, regulation, standard, rule, order, license, permit, authorization, judgment, decision, or other provision—of any kind and type, with legislative or regulatory content—in effect at the time the Booking is made or the Services are requested, that is applicable and relevant in connection with the Booking and/or the provision of the Services, as issued by the competent authority, including public security authorities, whether national, EU, or non-EU, including the Consumer Code and the decree on electronic commerce. 

Booking means confirmation of purchase of the air ticket for one or more flights operated by the Company or other airlines. The Customer may also use ​Time to Think service, which allows the price of a flight to be temporarily blocked prior to the purchase of the ticket, in accordance with the relevant service conditions.

Services means the services connected with the Booking of one or more flights managed and operated by the Company, including checking in and requesting a change, changing or refunding the Booking in relation to one or more flights, seat selection, purchasing extra baggage, and purchasing travel insurance.

Additional Services means services in addition to those related to air transportation, such as car rental, booking a stay at a property near the departure or destination airport, finding parking spaces, booking a shuttle service, and selling products available in the duty-free area online.

Site means the portal ​https://www.ita-airways.com through which Customers make Bookings and use digital Services .

User means the natural person who navigates through the pages and sections of the Site.

The Site belongs to, and is entirely managed and maintained by ITA. Access to and use of the Site, the purchase of tickets, and the provision of the Services imply full acceptance by the User, Registered User or Customer, without reservation, of these General Terms of Use, who declares that they have read and accepted them. The purpose of the General Terms of Use is to describe the conditions under which the User, Registered User or Customer may browse and use the Site and, if applicable, make a Booking or request a Service. For this reason, please read these General Terms of Use before accessing or using the Site, making a new Booking, or using the Services offered.

Through the Site, ITA will provide a portal to  the User, Registered User  or Customer for the online sale of flight tickets  and the provision  of Digital  Services.  If  you purchase  one  or more  flight  tickets  for one or more  flights  operated  by the Company  and  use the  Services  offered  on the Site,  the ​Conditions of Carriage  of ITA  will  apply, which we suggest that  you  read carefully before making a Booking  and  requesting a  Service  through the Site. 

In the context of the General Terms of Use,  ITA  is  considered  solely responsible for  the  sale of tickets  and the provision  of the Services. The Additional Services will be provided by ITA’s  partner companies,  which  must be  considered  responsible  for  the provision  of said Additional  Services, excluding any  liability  of ITA.

The Site can be browsed by all users  who have reached the age of consent in their country or territory of residence or, if minors, who have been authorized to use it by their parents or by those who exercise parental authority.

These General Terms of Use may be  subject to changes or updates,  and will be made  known  to  Users  with reasonable advance notice and in a transparent manner, even if the changes become necessary as a result of the introduction of new laws and regulations or for other reasons. The new General Terms  of use  will be effective as of their publication on the Site. By continuing to browse and  book flights  on  the Site  after the changes take effect, the User  agrees to abide by these new terms and conditions.  The new terms  of use will  not apply to Bookings  already  made  and will  have  no retroactive  effect.

ITA  reserves the right to modify the Site  and its contents  to offer new services or to comply with Applicable Law.  The General Terms of Use in force at  the time when you  make  a Booking  or  use  the Services shall apply.  If  any provision of the General  Terms of Use  is held to be invalid, void or unenforceable, this provision will not affect the validity and effectiveness of the other provisions.

The Site  and its  content, including, but  not limited to,  text, images, videos,  sounds and, in general, audio-visual materials, descriptions, drawings,  menus, web pages,  graphics (font, design, layout, colors), user interfaces, HTML  code and other computer code contained therein (hereinafter, the “Content”),  are  the exclusive property of  ITA  and  are  protected  by national and international copyright and intellectual  property  laws.

The  ITA trademark, figurative marks and/or trademarks comprised of a shape, all logos, images, service names  included on the Site and, more generally, all intellectual property rights relating to the  Services  are the exclusive property of  ITA  and are protected by trademark and patent law.  These General  Terms of Use do not permit the User to  reproduce, modify, tamper with, or use these trademarks, logos, images, and illustrations for any reason and in any media.

Copying or reproducing (except where copying or reproduction is made for non-commercial and personal use), publishing, disclosing, distributing, publicly providing, republishing, communicating, displaying, deleting, supplementing the Site  Content for any purpose is prohibited unless you have been authorized in writing by  ITA.

Downloading or copying the Content and using the trademarks included  on the Site, where authorized in writing by  ITA, does not entail the purchase by the User of any right, title or interest in the Site or in relation to its Content.

The User, the Registered User and/or Customer  may use the Site  and any of its Content solely  for personal and non-commercial purposes and always in compliance with these General Terms  of Use.  Access to the Site by the User, the Registered User and/or Customer  is temporary and  in any case  the Company reserves the right to withdraw, limit or modify the Services accessible to you on the Site without notice . Except as required by Applicable Law, the User, the Registered User and/or Customer may  not, and may not allow third parties to , use the Site for purposes other than those set out below; in particular, the User, the Registered User and/or Customer  undertakes not to:

• copy, reproduce, publish, transmit,  distribute, perform, upload, post, display, translate, modify or create content derived from, sell, license or otherwise distribute the Site and  its  Content, through mirroring, framing, linking to any other device, server, website;
• access or use the Site and  its Content for commercial purposes, including any advertising, marketing  or advertising revenue generation activities on its website;
• use the  deep-link,  page-scrape, chatbot, spider, or any  algorithm or  other automated or manual process to acquire, copy or monitor  the Site or its Content or portions thereof, or to reproduce in any way the structure or presentation of the Site or its Content;
• attempt to access any part or functionality of the Site that the User is not authorized to access, or any other system or network connected to the Site or any server of ITA, through hacking, password mining or any other unlawful or fraudulent means;
• use the password and account of other Registered Users at any time without the express consent of the account holder;
• probe, scan or test the vulnerability of the Site or any network connected to it, or breach or compromise the security or authentication measures configured on the Site;
• reverse search, track or attempt to track any information about any other Site User or any other Customer, or exploit the Site or any services or information made available or offered by or through the Site, nor use the Site or its Content for any illegal purpose or for any purpose not permitted by these General Terms of Use or promote the performance of any illegal activity or any other activity that infringes the rights of ITA or any other person;
• use any device, software, or tool to interfere or attempt to interfere with the proper functioning of the Site or any transaction conducted on the Site, or any other person’s use of the Site.

Without prejudice to any other rights of the Company, where ITA believes that the User, the Registered User  and/or the Customer violates the content of these General Terms of Use, the Company reserves the right to: i) cancel your Booking or your previous purchases without notifying you of such change, and ii) prevent and block access to the Site and to your Personal Account .

ITA has taken all reasonable security, technical and organizational measures, to ensure that the Site and Content are not infected by viruses, and to protect the integrity of data and electronic communications for the purpose of preventing unauthorized use or access to data, as well as to prevent risks of dissemination, destruction, and loss of data and confidential and non-confidential information regarding the Registered Users and Customers of the Site. However, where ITA has engaged in its activities with professional due diligence, ITA shall not be liable to the Registered User and/or Customer or third parties for any loss and/or damage arising from the use of the Site and/or Content, including, but not limited to:

• any loss or corruption of data;
• any loss or damage suffered by the Registered User and/or Customer as a result of the failure to take reasonable technical precautions against such loss or damage, such as the installation of appropriate antivirus software.

In order to access certain features or services offered on or through the Site, reserved for Registered Users only, and to make the Booking, you will need to register on the Site and create your Personal Account , which will allow you to access and use the features and services offered, and to make and manage Bookings. Opening your Personal Account requires entering your personal data in the online form and creating a password of your choice.

If you wish to access the Personal Area, the Registered User must enter their email address and password in the appropriate form and accept these General Terms of Use.

If you log out or log in via or from a different device, the same procedure must be followed.

The Registered User guarantees the authenticity and truthfulness of the information communicated to the Company. Any breach of this obligation may result in the suspension and/or cancelation of your Personal Account, without notice and without the right to any compensation. ITA reserves the right to verify, or have verified, all or part of the data provided by you.

If they create a Personal Account, the Registered User shall be responsible for maintaining the confidentiality of the login information (email address and password) and for controlling access to the Personal Account by unauthorized parties. It is understood that the User shall be responsible for all activities carried out through their Personal Account, unless they inform ITA that the Personal Account has been used by third parties without their consent.

ITA shall not be liable for any loss or damage resulting from failure to comply with the above obligations.

 Among other services and features reserved for Registered Users, by accessing your Personal Account you may:

• Quickly change and manage all ongoing bookings;
• View and obtain information and updates regarding bookings;
• Track bookings and access the history of air tickets already purchased;
• Check in through the Site, cancel, or request a refund;
• Reserve your seat in advance on the flight operated by ITA.

The Customer undertakes to promptly inform ITA of any changes to the data provided at any time.

The Site is accessible via any computer, tablet, smartphone or other device with an Internet connection.

The Site is available  24 hours a day, 7 days a week, except in the event of force majeure or an event beyond ITA’s control. 

ITA reserves the right to terminate access to the Site at any time or to suspend all or part of the provision of the Services for maintenance reasons, the improvement of new features, as well as for verification of proper functioning or in the event of a threat or malfunction arising from cyberattacks of any nature.

ITA cannot in any case be held liable:

• in the event of fraudulent use of the Site or use in a manner inconsistent with these General Terms of Use;
• in the event of force majeure;
• in the event of unavailability of the Site attributable to third parties or to an external cause independent of ITA, in particular in the event of disturbances, interruptions and anomalies not attributable to ITA and affecting the connection of the Internet network, regardless of severity or duration;
• in the event of temporary unavailability of the Site or suspension of all or part of its functionalities for reasons related to maintenance, updating, improvement, installation of new functionalities, as well as verification of correct functioning or in the event of a malfunction or threat of malfunction.

In no event  shall ITA  be  liable  for delay  or failure to perform  its obligations under these General Terms of Use  if the delay or failure results from an unforeseeable circumstance or force majeure. This provision does not affect the rights of Users, Registered Users and/or the Customer arising from the law and, in particular, the right to obtain the flight tickets purchased and use the Services offered or to be refunded in the event of a change or cancelation of the flight, for circumstances arising from an unforeseeable circumstance or for reasons of force majeure. The statutory provisions in some states may prohibit the limitations of liability set forth herein. In the event such provisions are applicable, the limitations of liability now set forth shall not take effect and additional rights may be granted to the User, Registered User and/or Customer . Nothing herein limits or excludes ITA ’s liability  in the event of death or personal injury  or  in the event  of loss or damage to  baggage,  caused by negligence or by ITA’s  willful misconduct or gross negligence.  In any event,  ITA ’s liability  in the event of deletion or modification of any Content from the Site  shall be excluded.

The User, the Registered User and/or the Customer  undertakes to  use the  Site  only  in accordance with its purpose.  Any use  other than or  contrary to the General Terms of Use  may  result in the temporary suspension and/or the permanent closure of the Registered User’s Personal Account, without prejudice to any other action, including legal action, that  ITA  intends to initiate  against the Registered User .

When  you browse,  purchase airline  tickets and request  the Services  offered  on the Site, the personal data of the User, Registered User and/or Customer  will be collected and processed  for  the processing of the Booking  and the provision of the Services  made available  on the Site.  It is recommended that you read our ​Privacy Policy and ​Cookie Policy which apply even if  you  access the Site and use the related services without making any Booking  or purchasing any Service. The Site  may sometimes contain links to content made  by third parties and/or links to other websites operated by  third parties, subject to the Company’s express approval.  ITA  does not control or monitor such content and websites and shall not be liable to the User for the content of such sites, in terms of accuracy, safety, or reliability, and/or for the rules adopted by them in relation to,  by way of example, the confidentiality and processing of the user’s personal data,  as well as for any loss or damage suffered (including, by way of example, any loss or damage to computer equipment, the user’s hardware and software) arising out of or related to access to or use of, or reliance on, any third-party content and websites.

These General Terms of Use  are governed by Italian law  and shall be construed in accordance with it, without prejudice to any other mandatory rules  that are more favorable to you  under the law applicable in the Customer’s country  of habitual residence .

For any disputes  that may  arise  in connection with these General Terms of Use  between ITA and the User  as a consumer,  the Court  of the country in which you have habitual residence  shall have sole jurisdiction . Alternatively, pursuant to Article  14 of Regulation 524/2013, the European Commission has established a European Online Dispute Resolution (ODR) platform.
