General Terms and Conditions

Italia Trasporti Aereo S.p.A., ("ITA Airways") has entrusted ITABUS S.p.A. ("Bus Company") with a road transport service on behalf of the same, reserved exclusively for passengers of ITA Airways ("Passengers"), to be carried out by bus, to enable transport from the stations of Pescara and Perugia to Fiumicino Airport and vice versa (hereinafter, the "Services").

These General Conditions of Contract (GTC) apply to the relations between ITA Airways and the Passengers in relation to the performance of the Services marketed by ITA Airways itself.     

These conditions govern the transport on the bus and supplement the General Conditions of Transport of ITA Airways that regulate air transport.

They are considered to be known and accepted by the Passenger by checking the relevant flag when purchasing the ticket.

 

Art. 1. Travel document 

The transport service on the bus is only open to Passengers with an ITA Airways boarding pass (which can only be generated via web check-in or mobile check-in before departure). In no case will it be possible to buy bus transport only. When departing from Perugia and Pescara, the check-in service via assistant or kiosk will not be available.  

The boarding pass must be kept by the Passenger for the entire duration of the journey and shown to the bus staff whenever requested.

The Passenger must be in possession of all entry and expatriation documents, visas necessary for the trip, health and vaccination certificates required by the country of destination, as well as documentation certifying the possession of the requirements for any dedicated or special fares purchased.

These documents must be valid at the time of the flight(s) and for the entire duration of the same. ITA Airways will not be held liable in the event of non-boarding of baggage resulting not in compliance with the requirements and will not be required to refund the ticket, except as provided for by the fare rules applicable to it and by the ITA Airways Conditions of Carriage.

ITA Airways will not be held liable in the event of denied boarding if, on arrival at the airport, the Passenger is found to not be in possession of the necessary travel documentation for the checks, and will not be required to refund the ticket, except as provided by the applicable fare rules and by the ITA Airways Conditions of Carriage.

 

Art. 2. Luggage transport.

Passengers must carry their baggage(s) within the limits provided, under the conditions and with the allowances provided by ITA Airways in the General Conditions of Carriage and in the fare rules available on the website https://www.ita-airways.com

The baggage in road transport is divided into:

Hand baggage: baggage of smaller size and/or value e.g. mobile phone, computer, PDA etc.

Checked baggage: baggage delivered to the bus attendant to be deposited in the luggage compartment.

The checked baggage must bear a clear and legible indication of the Passenger's name.

Passengers are responsible for hand baggage transported on the bus unless any damage or loss of baggage is due to negligent or willful conduct not attributable to them; it is also the responsibility of the passengers to make sure, when getting off the bus, to bring their hand luggage with them, for which they will be held solely responsible.                                         

Except in cases of willful misconduct or gross negligence, ITA Airways and the Bus Company are exempt from any liability for the following cases: (i) exchange or theft of Baggage; (ii) damage or amplification of damages resulting from inadequate packaging of the Baggage by the passenger and (iii) damage to the Baggage or the Passenger resulting from negligence by the latter.

On the basis of the provisions of the law in force (Article 2 of Law 22/08/85 No. 450) in relation to road transport, liability for checked baggage is limited to the maximum amount of € 6.20 per kilogram.

The unreserved receipt of the checked baggage constitutes, unless proven otherwise, the presumption that it has been delivered in good condition.

Any losses or failures must be ascertained under penalty of forfeiture at the time of delivery in the case of obvious failures, or within three days in the case of non-apparent failures (Article 1697 of the Italian Civil Code), by contacting the ITA Airways Contact Center.

In the event of non-compliance with the limits and allowances for the transport of baggage, which can be consulted on the website https://www.ita-airways.com, ITA Airways may request payment of the excess baggage fee and/or not check the baggage.

ITA Airways will not be held liable in the event of non-boarding of baggage resulting not in compliance with the requirements and will not be required to refund the ticket, except as provided for by the fare rules applicable to it and by the ITA Airways Conditions of Carriage.

After arriving at the airport, the Passenger must carry out the checks required by air transport regulations and the ITA Airways General Conditions of Carriage before boarding the flight and register the baggage to be sent to the aircraft hold

 

Art. 3. Opening times

The departure and arrival times of each bus will be modulated according to the departing and arriving ITA Airways flights and, therefore, the Passenger undertakes to be present at the boarding of the coaches at least 30 minutes before the departure time of the bus. In the event of non-arrival within the indicated terms, transport will not be guaranteed.

 

Art. 4. Assistance, delays and cancellations

In the event of delays, cancellations and inefficiencies, due assistance will be provided to Passengers in accordance with the provisions of 

Regulation (EU) No. 181/2011 (for bus transport) and by Regulation (EC) No. 261/2004 (for air transport).

 

Art.5. Transport of animals

The Passenger can bring with them, upon reservation, animals accompanied with their own carrier (small dogs, cats), with the exception of guide dogs accompanying blind Passengers for whom Law 14.02.74, No. 37 establishes that the blind person has the right to be accompanied by their guide dog without additional charges.

 

Art. 6. Transportation restrictions

Transportation is not allowed for: 

• unaccompanied minors.

 

 Art. 7. Conditions for providing assistance to Passengers with disabilities or reduced mobility

The transport of passengers with disabilities or reduced mobility is guaranteed in accordance with Regulation (EU) No.181/2011 (articles 9 et seq.) Without any charge provided that:

1. the person's need for assistance is communicated to ITA Airways with at least 48 hours' notice;

2. The person concerned shows up at the indicated point at least 30 minutes before the indicated departure time

The transport of Persons with disabilities or reduced mobility is guaranteed except in the following cases:

1. to comply with the obligations regarding safety materials established by EU, international and national legislation or the obligations regarding health and safety established by the competent authorities;

2. if the configuration of the vehicle or infrastructure makes it physically impossible to board the bus, disembark and transport the person with disabilities or reduced mobility in safe and concretely achievable conditions.

In the event that such impediments to transport are found, ITA Airways will promptly notify the disabled person or person with reduced mobility and, upon request, will be informed in writing within five working days of the request.

The Passenger will be informed of any acceptable alternative services operated by ITA Airways.

 

Art. 8. Rules of conduct on board the bus and obligations of conduct 

1. 

The Passenger is required to behave correctly, in compliance with the law, the ordinary rules of prudence and diligence and to follow the instructions of the personnel on the ground or on the coaches.                                         

The Passenger on board the bus, among other things, is not allowed:

a) to smoke.

b) to be present in an evident state of psycho-physical alteration and/or under the effect of alcohol and drugs;

c) to deposit luggage along the bus aisle;

d) to remain standing when the bus is moving;

 

Passengers are responsible for damage caused to property and/or persons due to negligent conduct and failure to comply with the aforementioned provisions 

Passengers may use mobile phones and/or other electronic equipment as long as their use does not disturb other Passengers.

In the event of violation by the Passenger of the obligations and prohibitions imposed on him by these General Conditions, the provision of the Services may be refused or suspended, including through the intervention of the police, if necessary, without any right of the Passenger. reimbursement of the total amount paid for the entire trip, unless otherwise provided for by the conditions of the fare purchased. The Passenger will be held responsible for any and all damage suffered by ITA Airways, the Bus Company and/or third parties due to the aforementioned violations.

 

Art. 9. Liability for damage in the event of an accident and Insurance

All vehicles used for the administration of the Services are covered by R.C.A. in accordance with current legal provisions.                                        

In particular, the RCA of vehicles guarantees insurance coverage of civil liability towards third parties, including transported persons, or things, with a single and overall ceiling at least equal to the minimum required by law.

In the event of an accident due to damage to persons and luggage, the provisions of Regulation (EU) No.181/2011.

 

Art. 10. Bus breakdown during the trip

In the event that the Bus becomes unusable during the journey, the continuation of the Service with another vehicle will be provided from the place where the unusable vehicle is located, seeking to guarantee the continuation of the journey.

 

Art. 11. Privacy

The Bus Company, in its capacity as external manager of the processing of personal data of ITA Airways customers, uses the personal data of the passenger for the purpose of carrying out the transport service on the road and any ancillary services.

The Bus Company processes personal data in accordance with the provisions of the legislation referred to in Regulation (EU) 2016/679 of the European Parliament and of the Council concerning the protection of individuals with regard to the processing of personal data, as well as the free circulation of such data Regulation and the Legislative Decree of 30 June 2003 n° 196, and subsequent modifications and integrations ii.

ITA Airways guarantees that personal data, however they might have been acquired, will be processed with respect to the basic rights, freedom and dignity of the party concerned, with special focus on confidentiality, personal identity and the right to personal data protection.

These data are collected, processed and used, mainly through automated systems, exclusively for the aforementioned purposes, pursuant to Art. 6.1 letter B) of the regulation as the processing is necessary for the execution of a contract of which the interested party is a party or for the execution of pre-contractual measures adopted at the request of the same;

Even "sensitive data" may be processed for the purpose of carrying out the air transport service and any accessory services, pursuant to the mentioned Privacy Law.

The Data Controller is Italia Trasporti Aereo S.p.A., in the person of its legal representative, domiciled at the registered office in via XX Settembre, No. 97, in Rome (RM), 00187, C.F. and P.I. 15907661001 (hereinafter also "Data Controller").
