1. General rules
1.1. These Terms and conditions govern the relationship between users and ITA Airways, with registered offices in Via Venti Settembre 97, 00187, Rome, Italy; Tax Code, VAT number and Rome Companies Register no. 15907661001; Rome Economic and Administrative Index (R.E.A.) no. 1622937 (hereinafter "ITA Airways").
1.2. Purchasing and/or using a Gift Card implies full acceptance of these Terms and conditions, which are made available to users at the time of the purchase and via the Gift Card delivery email, and are also available on www.ita-airways.com.
1.3. The following terms shall have the meaning defined below, unless the context requires otherwise:
a. Gift Card: the digital card that can be purchased on www.ita-airways.com. This is a prepaid card that can be used to purchase round-trip or one-way air tickets on www.ita-airways.com.
b. Issue Date: the original issue date of the Gift Card.
c. Expiration Date: the end date beyond which the consumer may no longer use the Gift Card.
2. Terms of use
3.1. The Gift Card is non-refundable. Under no circumstances may it be paid out in cash or transferred against value. Further sale of the Gift Card is likewise not permitted.
3.2. The Gift Card may be used multiple times, within the validity period, until the total balance of the Gift Card has been used up completely. After the expiration date, the Gift Card may not be used, renewed or reactivated, nor may any unused remaining balance on the Gift Card be claimed or redeemed for cash. No refunds or credit notes shall be issued for the unused portion of the Gift Card.
3.3. The Gift Card may not be used to purchase further Gift Cards.
3.4 The Gift Card is not nominal and will not be refunded even in the event of theft or loss.
4. Using the Gift Card
4.1. The Gift Card may only be used to purchase round-trip or one-way airline tickets via www.ita-airways.com.
4.2. The Gift Card may be used up to its expiration date as specified in the Gift Card delivery email. The Gift Card expires at 23:59 UTC on the expiration date shown.
4.3. The flight must be completed within 12 months following the Gift Card expiration date.
4.4. The Gift Card may be used when booking on www.ita-airways.com.
On the payment page, enter the Gift Card number and relating PIN number in the respective fields.
4.5. Gift Cards can be used with other discount codes and Gift Cards (a maximum of 3 Gift Cards is permitted only if the value of the same covers the total cost of the ticket).
4.6. When purchasing a ticket, the Gift Card credit shall be applied to the total cost of the flight (fare, taxes and Extra Services if selected). When making a payment with a Gift Card, if the amount to be paid is equal to or greater than the available credit, the Gift Card will be used in full. In this case, the entire payment shall be made using the Gift Card and, if the amount to be paid exceeds the Gift Card balance, the remaining amount shall be paid using another accepted payment method: credit card (Visa, MasterCard and American Express) or other valid gift cards and vouchers. Gift Card payments cannot be combined with PayPal payments. At the end of the transaction, the value of the Gift Card will be adjusted to reflect any remaining credit, which will remain valid under the same conditions as above (without the possibility of being refunded or of the validity of the Gift Card being extended).
4.7 The Gift Card is non-refundable.
4.8 The Gift Card may only be purchased in Italy.
4.9 Gift Cards cannot be used with the Cash&Point program and «Block the Price» service.
4.10 In the event of voluntary cancellation of flight tickets paid fully or partially with a Gift Card, the fare rule of the ticket will apply. Therefore, if the ticket is refundable, the amount will be refunded on the original form of payment used. If the payment was made with a Gift Card, the value will be re-credited while maintaining the original expiration date.
4.11 In case the flight is cancelled by ITA Airways, the ticket will be refunded on the original form of payment used by the customer for the purchase. If the payment was made with a Gift Card, the value will be re-credited while maintaining the original expiration date.
5. Liability and risk of loss
5.1. The purchaser takes on ownership and the risk of loss of the Gift Card when this is transmitted to the purchaser or the designated recipient.
5.2. ITA Airways is not responsible for the loss, theft, destruction or unauthorized use of the Gift Card. Neither ITA Airways nor any of its employees are required to identify the person submitting the Gift Card.
5.3. ITA Airways accepts no responsibility in the event of the email address of the Gift Card recipient being incorrect.
6. Miscellaneous provisions
6.1. ITA Airways reserves the right to supplement or otherwise amend these Terms and conditions at any time and at its sole discretion. Such supplements or amendments shall not apply to Gift Cards issued beforehand.
6.2. These Terms and conditions are governed by Italian law. Any dispute that may arise shall be submitted to the jurisdiction of the courts of the place of residence or domicile of the consumer, pursuant to Italian Leg. Decree 206/2005.
