Contingency Plan for Lengthy Tarmac Delays at U.S. Airports Italia Trasporto Aereo, S.p.A.

This plan is required by the United States Department of Transportation’s regulations at 14 C.F.R. § 259.4. This plan applies to Italia Trasporto Aereo, S.p.A.’s (“ITA”) operations at U.S. airports. This plan is designed to meet the needs of passengers that experience a lengthy tarmac delay at a U.S. airport while onboard an ITA-operated flight. A tarmac delay is defined as the period of time when an aircraft is on the ground with passengers and the passengers have no opportunity to deplane.


Plan Commitments


1.     For all flights operated by ITA, ITA shall provide a passenger on a flight experiencing a tarmac delay at a U.S. airport the opportunity to deplane before the tarmac delay exceeds four hours in duration, except in the following cases:

a.     For flights departing a U.S. airport, if the flight begins to return to a suitable disembarkation point no later than four hours after the main aircraft door is closed in order to deplane passengers;

b.     If the pilot-in-command determines that deplaning passengers at a suitable disembarkation point would jeopardize passenger safety or security, or there is a safety related or security related reason why the aircraft cannot leave its position on the tarmac to deplane passengers; or

c.     Air traffic control advises the pilot-in-command that returning to a suitable disembarkation point to deplane passengers would significantly disrupt airport operations.

2.     For all covered flights, ITA will provide adequate food and potable water no later than two hours after the start of the tarmac delay, unless the pilot-in-command determines that safety or security considerations preclude such service.

3.     ITA will ensure operable lavatory facilities, as well as adequate medical attention if needed, will be provided during a tarmac delay.

4.     ITA will notify the passengers on board the aircraft during a tarmac delay regarding the status of the delay when the tarmac delay exceeds 30 minutes, and thereafter ITA may provide subsequent updates, including flight status changes, as ITA deems appropriate.

5.     For all departing flights and diversions, each time the opportunity to deplane exists at a suitable disembarkation point, ITA will timely notify the passengers on board the aircraft that the passengers have the opportunity to deplane.

6.     ITA commits that it has sufficient resources to carry out this plan.

7.     ITA will ensure that its plan is coordinated with the relevant Customs and Border Protection (“CBP”), Transportation Security Administration (“TSA”), and airport authority personnel at each airport ITA serves, including airports that it regularly uses for diversions.
